Your instructor
Your instructor is a self-employed franchisee (Your Instructor) of Reallygooddrivingschoolglasgow.com
Lessons
The contract for driving tuition is solely between You and Your Instructor. You and Your Instructor are responsible for agreeing all matters relating to the timing, location and duration of individual lessons.
As Really Good Driving School is not party to the contract between you and your Instructor, it accepts no responsibility for any payments you make directly to your Instructor.
All bookings are accepted on the STRICT understanding that the pupil has read, understood and accepted our terms and conditions.
TESTS
If your instructor feels you are not ready to take your practical driving test, even on day of exam, because of safety, then pupil will NOT be allowed to take practical test. NO refund for your test or driving course, will be offered to you. If during lessons leading up to a test, it is thought that the pupil would not pass the practical driving test, then they will be informed and – if possible – offered extra hours to bring the driving up to driving practical test standard, so long the instructor has the space in their diary to accommodate the extra hours, or, if time allows, the test date could be deferred.
ATTENDANCE
You must attend each driving lesson on time – the instructor will wait no more than 10 minutes for your arrival. If you do not attend within that timeframe, the lesson will be charged.
FAILURE TO ATTEND
Pupils failing to attend pre arranged and agreed lessons with their instructor are liable to pay the full cost of the lesson duration.
FITNESS TO DRIVE
You must be in a fit state to drive. If the instructor believes you are unfit to drive, through alcohol, drugs, or medical related issues, your driving lesson will be CANCELLED. No refund will be offered.
You must notify Your Instructor of any matters which affect your ability or entitlement to have driving tuition, for example, but not limited to, any lack, or loss, of a valid provisional driving licence. If you fail the eyesight test on the Practical Driving Test, no refund will be given.
Really Good Driving School cannot be held liable for any compensation claim from pupil, nor can it be held responsible for any traffic law violation on the part of the pupil.
ANTI-SOCIAL BEHAVIOUR
Abusive behaviour towards your instructor may result in termination of lessons. You will not be refunded in such event.
If at any point you cancel or fail to attend whilst on intensive driving course, then you will be deemed to have forfeited those hours.
Neither Reallygooddrivingschoolglasgow.com or the instructor can be held responsible for any practical driving test cancellations made by the D.V.S.A.
We can accept PAYPAL payment , however a surcharge of 3.4 % plus £0.20p is payable at the time of the payment.
It is your responsibility to ensure you bring all relevant paperwork for the Tests.
Cancellations
If You wish to cancel a lesson a minimum of 48 hours prior notice should be given. Cancellations must be made directly between You and Your Instructor. If you do not give at least 48 hours notice of cancellation, Your Instructor will be entitled to charge for the lesson(s) concerned.
Payments and lesson bookings
You must pay for tuition in advance by using one of the following methods:
Payment by cash, cheque or bank transfer directly to your instructor.
Really Good Driving School has no responsibility or liability to You for payments made by other means, and further if you do pay Your Instructor directly by cash, cheque or bank transfer, You should obtain a receipt. Really Good Driving School accepts no responsibility for any payments made direct to Instructors.
Price changes
The price of lessons which have not been pre-paid as part of a block booking may be changed at any time. You will always receive prior notice of such changes.
The cost of prepaid tuition is based on the lesson price in force at time of booking, and will be honoured for 6 months thereafter irrespective of any price increase that may occur between the date of booking and when the lessons are taken. Any unused lessons remaining after 6 months have elapsed shall have any lesson price increase applied.
Transferability of lessons
You cannot sell or transfer lessons which have been purchased in Your name to any other person without consent.
Liability
Your Instructor, and Really Good Driving School Glasgow are not liable to You for any loss or damage caused where, and to the extent that:
there is no breach of a legal duty owed to You by the relevant person or body;
such loss or damage is not a reasonably foreseeable result of such a breach;
any such loss or damage, or increase in the same, results from any breach or omission by You;
any such loss or damage results from circumstances or matters outside of the reasonable control of the relevant person or body
Your Instructor, and Really Good Driving School Glasgow shall not, in any event, be liable for losses relating to any business interests You may have including, without limitation, lost profits, loss of opportunity or business or business interruption.
You are reminded that Really Good Driving School is not party to the contract for driving tuition itself, which is between You and Your Instructor. This does not affect any liability that Really Good Driving School may have for any loss or damage You may incur which is caused directly as a result of any breach (including negligence) by it or them of any legal duty owed by it or them to You.
Complaints
Really Good driving School advises that, in the unlikely event of any grievance between you and your Instructor, this should be resolved between both parties, or the Driving Vehicle Standards Agency.
Nothing in these terms and conditions will affect any statutory rights You may have as a consumer.
You must notify Your Instructor of any matters which affect your ability or entitlement to have driving tuition, for example, but not limited to, any lack, or loss, of a valid provisional driving licence.
Really Good Driving School acts as agent for Your Instructor in receiving Your payments for driving tuition, other than payments made directly by You to Your Instructor. Where Really Good Driving School makes bookings with, or supplies any information or documentation to You, or processes any payments for Your lessons, they act as the agent of Your Instructor.
Intensive Courses
All intensive courses are booked on the understanding that the pupil understands our terms and conditions. A non refundable deposit of £200 must be paid at time of booking.
The full balance of the course must be paid at least 7 days prior to course commencement. If the pupil cancels within this period, then no refund will be offered.
